Several factors influence whether your accident claim will be a success or not.

Timescale.
It is unlikely that a solicitor will be willing to deal with the case if the incident occurred more than three years ago. The limitation period for most personal injury claims is three years and if the case is not settled or proceedings have not been issued in a court of law prior to that time then the matter becomes statute barred. However you may be able to find an exception to this rule. One of these exceptions is if the person you are claiming against is not yet an adult the three years will not begin until they turn 18. If your claim was more than three years ago you can still seek legal advice to see if your case could be an exception.

Injuries.
The doctor who originally treated the injury will hold medical details, which are of paramount importance when making an accident claim. The solicitor will use this record as evidence of the type and cause of the injury and if necessary will obtain another specialist’s medical opinion as the case proceeds. This is why it is so important that you have a medical check-up immediately after n accident either in a hospital or at your local GP’s surgery.

The Police.
An accident claim solicitor will liaise with police officers who were at the scene of the accident when it happened or shortly after. Your solicitor should get a copy f the police report as this will be used as evidence. If a civil case is taking place the police officer may be called as a witness.

Witness Statements
Any people who witness the accident should give a statement to the authorities. If you have a supportive witness statement this will help a lot in a case. However if you personally collected the stamen then it will be considered invalid. A solicitor or a private inquiry agent employed on the client’s behalf will usually obtain signed statements which will verify the client’s version of events.

The Evidence
Your accident claim is likely to be more successful with the more evidence that is collected. It is recommended that victims take photos of the scene, any damage and any injuries.
